Terms of Service for EPS Wallet
These Terms of Service for EPS Wallet (hereinafter referred to as the “Terms of Service”) constitute an agreement between Element Payment Solutions Laos Co., Ltd., whose headquarters is located at 286, VeitinBank Building, Hatsady Neua Village, Chanthabouly District, Vientiane Capital, Lao PDR (hereinafter referred to as the “Company”), and the users of EPS Wallet (hereinafter referred to as the “Users”).

The purpose of this agreement is to outline the terms under which Users can utilize the EPS Wallet service (hereinafter referred to as the “Service”). Users can conduct financial transactions using the Company’s electronic money stored in their EPS Wallet account (hereinafter referred to as the “Wallet”), as well as through credit cards, debit cards, electronic cards, and bank accounts linked to their EPS Wallet account. Transactions such as top-ups, payments, transfers, and withdrawals can be performed conveniently through the EPS Wallet application (hereinafter referred to as the “Application”).
Users are responsible for thoroughly understanding these Terms of Service before using the Service and regularly reviewing any updates. If there are any questions regarding the Service, Users may contact ElementPay through all available channels.

1. General Provisions

1.1 Users agree to comply with and be bound by these Terms of Service. The use of the Service by Users constitutes acceptance of these Terms of Service. The Company reserves the right to modify or add to these Terms of Service at any time. The Company will notify Users of such changes, and continued use of the Service after any modification or addition shall be deemed acceptance of the changes.

1.2 Unless otherwise specified, any new features, modifications, or enhancements to the Service shall be subject to these Terms of Service.

1.3 The Company reserves the right to update or discontinue the Service or any part of it, either temporarily or permanently, at any time. The Company will provide prior notice where applicable. The termination or suspension of the Service or any part of it shall not affect any outstanding debts owed by the User to the Company. Additionally, it does not eliminate any rights or liabilities that have accrued between the Company and the User prior to the termination or suspension.


2. General Terms and Conditions of Use

2.1 To register for the Service, Users must open an EPS Wallet account (hereinafter referred to as the “EPS Wallet Account”) to conduct transactions related to the Service. Users must follow these procedures:

2.1.1 For Lao Nationals: Users must provide their full name, email address, mobile phone number, address, occupation, workplace, date of birth, and national ID number, along with any additional information required by the Company to comply with its service policies and/or applicable laws.

2.1.2 For Foreign Nationals: Users must provide details regarding their visa type for residency in Laos, their residence in Laos, a photograph of their passport (valid for at least six more months), and any additional information required by the Company to comply with its service policies and/or applicable laws.
Once Users have provided the required information, they must set a password consisting of letters, characters, numbers, and symbols, including biometric information, as specified by the Company (hereinafter referred to as the “Password”). Users may later change their Password according to the Company’s terms and conditions.

2.2 The Company reserves the right to refuse registration, provision of services, and/or transactions for Users who conceal their true identity, use an alias, or register with incorrect, false, or outdated information. Additionally, the Company may restrict access to certain types of services based on User categories as defined by the Company. The Company also reserves the right to refuse service to Users based on age, nationality, residence, or occupation, at its sole discretion. Users acknowledge and accept that the approval of service registration and the provision of specific services are subject to the Company’s sole discretion.

2.3 Users must keep their Password and registration information confidential and must not disclose or take any action that would allow others to access their Password and/or registration details. Users acknowledge that any transactions made using their Password shall be deemed as having been performed by the User themselves, and the Company shall not be responsible for any resulting damages.

2.4 Once a transaction related to the Service is completed, the User acknowledges that the transaction cannot be canceled, withdrawn, modified, or altered. The User shall be bound by all completed transactions.

2.5 Users may use the Service to pay for goods and/or services, perform financial and banking transactions, and conduct any other transactions that the Company may expand upon in the future.

2.6 Users acknowledge that if an incorrect Password is entered more times than the Company allows, the Company will automatically suspend the Service. Users can resume using the Service only after requesting a new Password following the Company’s prescribed procedures.

2.7 In cases where Users forget their Password or wish to change it for any reason, they must immediately notify the Company following the Company’s specified process. However, such changes will not affect any transactions completed before the notification.

2.8 The service user agrees to pay the service fees at the rates specified by the company. The user can check the fees on the company's website. In cases where the user must pay any fees to the company as outlined above, the user agrees to allow the company to deduct funds from the wallet to pay the fees on the due date immediately. The user agrees to maintain sufficient funds in the wallet to cover these fees. Once the company has received the payment, the company will send an electronic receipt/electronic tax invoice to the user as evidence, which will be sent via the designated communication channel.

2.9 In addition to the funds in the user's wallet, the user may carry out financial transactions using other types of funds by linking the EPS wallet to various channels provided by the company (hereinafter referred to as "Source of Funds"), including but not limited to credit cards, debit cards, electronic cards, bank accounts (automatically deducting from the bank account or direct debit), etc. The service conditions of each Source of Funds are as stated in Clause 4 of these terms and conditions, as well as any additional specific conditions the company may set for each Source of Funds in the future.

2.10 The service user can set the system to process payments for goods and digital services through the application ("Set Digital Goods and Services Payment") following the procedure and method specified by the company. The company reserves the right to set the digital goods and services payment by itself in the future, according to the procedure and method determined by the company.

2.11 For users with Lao nationality, they can use the EPS wallet to pay for goods and/or services, as well as carry out financial transactions, up to the specified limit per transaction, per day, and per month, depending on the user's identity verification level displayed in the application. For foreign users, they can use the EPS wallet to pay for goods and/or services, as well as carry out financial transactions, up to the specified limit per transaction, per day, and per month, depending on the user's identity verification level as set with the company. The company has the right to change these limits at any time and will notify the user in advance. Additionally, the user can adjust the limit in the application by verifying their identity or following the steps determined by the company. However, the change cannot exceed the maximum limit defined for the user's identity verification level.

2.12 The company reserves the right to refuse to process payments or accept payments for goods and/or services under the following conditions:

2.12.1 Payment or acceptance of payment for goods and/or services on behalf of a legal entity or other individuals.

2.12.2 Payment or acceptance of payment for certain types of goods and/or services that have been suspended, and which involve a line connection fee.

2.12.3 Payment or acceptance of payment for certain goods and/or services with overdue debts. 2.12.4 Payment or acceptance of partial payments for goods and/or services.

2.12.5 Payment or acceptance of payment for goods and/or services that violate the law, public morals, the electronic card network user's requirements, or any other specific requirements set by the company.

2.12.6 Payment or acceptance of payment for goods and/or services exceeding the number of transactions set by the company per month.
The conditions for payment of goods and/or services are according to the terms set by the respective provider(s).

2.13 In case of errors in deducting or transferring funds into the user's wallet caused by the company, the user agrees to allow the company to correct the error to reflect the true amount, including but not limited to the deduction or transfer of funds into the wallet. The company will notify the user of the error and the incorrect amount. If the error results in the company making a payment on behalf of the user, the user agrees to repay the company in full. If the company finds that the balance in the user's wallet is insufficient to rectify the error, the company reserves the right to suspend services to the user until the wallet has sufficient funds, and the company has made the necessary deduction.
If the error in deducting or transferring funds is not caused by the company, the user will need to verify and claim or refund the incorrect amount directly from the dispute party. If the user has any disputes or claims, they will need to resolve them with the dispute party.

2.14 The company reserves the right to temporarily hold funds in the user's wallet for inspection if the company finds or becomes aware of any of the following situations:

2.14.1 If the company has reasonable evidence that the user received funds in their wallet due to an error in a transfer from another user.

2.14.2 If the company has reasonable evidence to believe the user received funds in their wallet from illegal actions or attempts to violate the law, or for any reason that could cause harm to the company or others.

2.15 In the event that the company detects that the funds in the user's wallet are insufficient to pay for goods and/or services, or if the goods and/or services are lower than the minimum spending amount set by the company, or if the goods and/or services exceed the credit limit set by the company for the user, the company has the right to suspend services to the user as per section 6.2 of these terms and conditions.

2.16 The company reserves the right to suspend or cancel the user's service without prior notice if the company finds any of the situations as described in section 6.2 of these terms and conditions.

2.17 According to the Anti-Money Laundering Act, including relevant announcements and regulations currently in effect and/or those that will take effect in the future, the company, as an electronic money service provider, is required to comply with the Anti-Money Laundering Law and the law regarding the prevention and suppression of financing terrorism and the spread of weapons of mass destruction. Therefore, users must register and provide identification documents for the company to verify and authenticate their identity and ensure the accuracy of the provided data according to the law. If the user fails to complete the registration or provide the necessary documents within the specified time, and/or the company cannot verify the user’s identity, the user agrees to allow the company to suspend services or refrain from conducting transactions temporarily until the user has completed the registration and provided the required documents. If the user fails to comply within 90 (ninety) days from the date the company suspends or refrains from services, the company reserves the right to cancel the user's EPS Wallet account and/or take other actions as deemed appropriate.

2.18 The company reserves the right to change the criteria for approving and limiting the number of EPS Wallet accounts per individual national ID number or passport number as deemed appropriate without providing reasons to the user.

2.19 The user acknowledges that under the following circumstances, their services may be canceled, suspended, or the EPS Wallet account may be closed, preventing the user from performing any transactions:

2.19.1 The user’s registered mobile phone number with the company is suspended, and the user may not be able to perform transactions with the EPS Wallet account until the suspension is lifted; or

2.19.2 The user changes the mobile phone number registered with the company, cancels the use of the registered mobile phone number, or the registered mobile phone number is canceled for any reason.
In such cases, the user acknowledges that they must withdraw funds from the wallet before changing the phone number or before the phone number is suspended or canceled. Otherwise, the company will not be responsible for any damages that may occur.

2.20 The user can view the transaction history for payments made through the wallet or any Source of Funds linked to the EPS Wallet for the past 3 (three) months via the application. In cases where the user has made payments using the wallet, the user can request transaction evidence for up to 1 (one) year via the application or other channels specified by the company. The user can request transaction evidence a limited number of times per day, and the evidence will be sent to the user’s email address provided to the company. Transaction evidence refers to the statement and any other proof generated by a computer or storage media used to store data, or any other evidence that may be required by the Central Bank of Laos in the future. This transaction evidence is confidential and should not be disclosed to external parties.

2.21 The user can inquire about service information and/or report issues with the service through the EPS Wallet or any other channel specified by the company.
3. Terms and Conditions for Transferring Funds to a Bank Account

3.1 The user must initiate the transfer request via the application to transfer funds from their wallet to the desired bank account, following the steps and procedures specified by the company.

3.2 The user acknowledges and agrees that a fee will be charged for transferring funds from the wallet to the desired bank account. The user can check the fees on the website www.epswallet.com The fee will be deducted from the wallet balance immediately upon request.

3.3 Under section 2.11, the amount the user can transfer per day and per month will depend on the level of user identity verification.

3.4 The user cannot cancel a transfer request once it has been submitted.

3.5 If the company detects that the wallet balance is insufficient to cover the requested transfer amount and transaction fee, the company reserves the right to suspend the service.

3.6 If the company’s service is disrupted due to a bank’s system issue, the company will automatically refund the funds to the user’s wallet within 3 (three) business days after receiving notification from the bank.

3.7 In cases where the user’s transfer request cannot be completed for any reason, the user acknowledges that the company will not refund the transaction fee unless the failure is caused by a system issue from the company or the bank.


4. Terms and Conditions for Using Source of Funds in the Application

4.1 Users must have an EPS Wallet account before they can link any Source of Funds to their EPS Wallet account. The company reserves the right to provide this service only for the Source of Funds that the company has made available for connection with the EPS Wallet account.

4.2 Users acknowledge and agree that once they have linked a Source of Funds to their EPS Wallet account, the company may need to access the information of that Source of Funds in order to display it within the application on the user’s device or through other channels as determined by the company. This is to facilitate the user's convenience in using the Source of Funds service under these terms.

Once the user has successfully linked a Source of Funds to their EPS Wallet account, the company will automatically add the newly linked Source of Funds to the payment priority order.

4.3 The company reserves the right to limit the number of Source of Funds accounts that users can link to their EPS Wallet account as follows:
  • Up to three (3) credit or debit cards per EPS Wallet account
  • Up to five (5) bank accounts per EPS Wallet account
The company may change these limits in the future and will notify users in advance.

4.4 Users are not required to pay any service fees for using the Source of Funds, except when using the application to make payments for goods and/or services. However, for certain Source of Funds such as credit or debit cards, the company may conduct a temporary transaction to verify the user’s identity. The amount deducted will be refunded immediately, and users will not be charged any fees for this verification process.

4.5 Once a Source of Funds has been linked to the user's EPS Wallet account, the user agrees that if they make a payment for goods and/or services through their EPS Wallet account using that Source of Funds, the company is authorized to deduct the required amount from the linked Source of Funds to complete the transaction with the merchant or service provider.

4.6 Users can only conduct specific transactions with each type of Source of Funds as determined by the company. Additionally, payments using each type of Source of Funds can only be made for certain merchants or service providers designated by the company.
The following transactions are not allowed using credit or debit cards:
  • Credit card bill payments
  • Peer-to-peer (P2P) transfers between EPS Wallet accounts
The company reserves the right to modify the types of transactions, as well as the goods and/or services that can be paid for using different Source of Funds in the future.

Additionally, if a user makes a peer-to-peer (P2P) transfer to another EPS Wallet account using a linked bank account, the user agrees that the company will first deduct the amount from their linked bank account and deposit it into their EPS Wallet. The company will then proceed with transferring the funds to the recipient’s EPS Wallet. Users also agree to pay any applicable top-up fees as specified in the EPS Wallet application.

4.7 Cancellation and Refund Policy

4.7.1 Cancelling a Payment for Goods and/or Services

If a user wishes to cancel a payment for goods and/or services, they must request the cancellation directly with the merchant or service provider within the designated time frame.

For full payments, the cancellation request must be made within 30 days from the transaction date.

The company will process the cancellation within 7 business days from the date the request is confirmed.

Refunds will be issued only to the original Source of Funds used for the transaction. If a refund cannot be processed to the original Source of Funds (e.g., a bank account), the user agrees that the company may credit the refund amount to their EPS Wallet instead. The company will complete this process within 7 business days.

If the payment was made using a Source of Funds other than the user’s EPS Wallet balance, the user acknowledges that banks, financial institutions, or credit/debit card issuers may take between 5 to 45 business days to process the refund, depending on their individual refund policies. If the refund is not received within the specified period, the user should directly contact the respective bank, financial institution, or Source of Funds provider.

4.7.2 Peer-to-Peer Transfers

If a user successfully completes a peer-to-peer (P2P) transfer to another EPS Wallet account, they acknowledge and agree that the transaction cannot be canceled or reversed.

4.8 Acknowledgment of Service Scope
The user acknowledges that the company solely provides a service to facilitate transactions using the Source of Funds linked to the user's EPS Wallet account, strictly according to the user’s instructions. The company does not act as a bank, financial institution, credit card provider, debit card provider, electronic card provider, or financial service provider in performing these transactions.
The company’s services do not constitute:
  • Direct money transfer services for users, and/or
  • Trustee (Trustee), custodian, or manager of the user’s funds.
If any issues arise due to the use of different Source of Funds linked to the user's EPS Wallet account, beyond cash transactions, the user agrees to directly contact the respective bank, financial institution, credit card provider, debit card provider, electronic card provider, or Source of Funds provider for resolution. The company holds no involvement in such matters.
5. Terms and Conditions for Payment Priority

5.1 Setting Up Payment Priority

Once the user has successfully linked a Source of Funds to their EPS Wallet account per the company’s process, they can set the payment deduction order for each Source of Funds through the application or other channels specified by the company.

5.2 Payment Priority for Digital Goods and Services

If the user opts for Payment Priority when making payments for digital goods and services, the system will follow the specified order under the following conditions:

  • 5.2.1 If the user has not set a payment order, the system will always deduct funds from the wallet balance first.
  • 5.2.2 The user cannot prioritize certain Source of Funds over others unless allowed by the company's specified conditions.
  • 5.2.3 If a payment order has been set, the Payment Priority system will select the Source of Funds with the highest likelihood of a successful deduction. If multiple sources qualify, the system will follow the user’s predefined priority.
  • 5.2.4 The company may set a minimum transaction amount for bank account deductions (Direct Debit). If the payment amount meets this threshold, the user will receive the difference in their EPS Wallet balance.
  • 5.2.5 The user acknowledges that withdrawing this balance from the EPS Wallet to a bank account may incur fees as determined by the company.
  • 5.2.6 Users can add, remove, or modify the payment order for each Source of Funds under Payment Priority following the company's procedures, except for the wallet balance, which cannot be removed.

5.3 No Service Fees for Payment Priority

The user is not required to pay any service fees to the company for using the Payment Priority feature.

5.4 Display of Payment Priority on Other Platforms

The user acknowledges and agrees that the Payment Priority settings, which define the order of Source of Funds linked to their EPS Wallet, may be displayed as a payment option on other applications or partner websites for transaction facilitation. Additionally, once the Payment Priority setting is configured, the system will use these settings to display Source of Funds details within the user's application when making payments at merchants.
These terms are subject to the company’s policies and conditions.


6. Service Cancellation and Suspension

6.1 Service Cancellation by the User

If the user wishes to cancel the service, they may do so through the following methods:

  • 6.1.1 The user may cancel their EPS Wallet account through the application, following the company's specified criteria and procedures. However, if the EPS Wallet account is subject to certain conditions set by the company, the user will not be able to cancel the account through this method.
  • If the EPS Wallet account can be canceled and there is a remaining balance in the wallet, and the user wishes to transfer this balance to their bank account, the company reserves the right to charge a transfer fee.
  • If the EPS Wallet account can be canceled and there is a remaining balance in the wallet, but the user does not wish to transfer the balance to their bank account at the time of cancellation, the company will charge a maintenance fee from the remaining balance. The user can check the applicable fees at www.epswallet.com If the user later wishes to reclaim the remaining balance, they may do so by notifying the company in advance through the designated channels and following the company's procedures. The remaining balance will be refunded after deducting the maintenance fee, within the period specified by the company.
  • 6.1.2 The user may submit a cancellation request through the contact number +856-20-56-996-464 and follow the company's specified procedures. If there is a remaining balance in the wallet and the user has not violated any service terms, the company will refund the remaining balance after deducting any applicable fees (if any) within a maximum of 15 business days via transfer to the user's designated bank account. The company reserves the right to charge a transfer fee (if applicable).
  • 6.1.3 The user may request cancellation through other channels as designated by the company and must follow the company’s procedures.
The user agrees not to claim any interest or compensation from the company regarding the service cancellation.

6.2 Service Suspension or Termination by the Company

The company reserves the right to cancel, suspend, or close the user's EPS Wallet account without prior notice in the following cases:

  • 6.2.1 The user provides false documents or misleading information during the EPS Wallet registration process, including submitting incomplete or fraudulent documentation as requested by the company.
  • 6.2.2 The user passes away.
  • 6.2.3 The user is subject to asset seizure or freezing by government authorities or is suspected of committing or being involved in illegal activities.
  • 6.2.4 The company has reasonable suspicion that the user has committed or attempted to commit an offense under applicable laws or engaged in activities that may cause harm to the company or others.
  • 6.2.5 The registered mobile number associated with the EPS Wallet is deactivated for any reason, and the company has been notified of its cancellation along with relevant supporting documents.
  • 6.2.6 The user is a foreign national whose nationality, residency, or occupation falls under restricted categories specified by the company.
  • 6.2.7 The user violates any of the terms and conditions of service.
  • 6.2.8 The user has not accessed the service for more than six consecutive months since their last login.
  • 6.2.9 The user is a foreign national whose passport has expired while using the service.
  • 6.2.10 The user’s wallet balance is insufficient to cover any applicable fees charged by the company.
  • 6.2.11 The company becomes aware that the user has been legally declared incompetent or quasi-incompetent and has not received consent or authorization from their legal guardian to register and use the service.
The company is not responsible for any losses or damages resulting from the suspension or termination of the service.
Additionally, if the company has reasonable suspicion or is required to comply with legal obligations, it may request further clarification, documentation, or evidence from the user. If the user fails to comply within the specified timeframe, or if the company determines that the user meets any of the conditions outlined above, or if legal reasons necessitate the termination of the service, the company reserves the right to cancel or suspend the service immediately.

6.3 In the event that the Company exercises its right to cancel or suspend the service under Clause 6.2 above, the Company is entitled to take the following actions:
  • If the user's EPS Wallet account has no remaining funds, or if the funds in the user's wallet are insufficient to cover the account maintenance fee, the Company will deduct the remaining balance in the user's wallet as the account maintenance fee and immediately terminate the service; or
  • If the user's EPS Wallet account has a remaining balance, the Company will retain the funds in the user's wallet and charge an account maintenance fee and/or a fund custody fee (as applicable). Users can check the applicable fees on the website www.epswallet.com The user has the right to request a refund of the remaining balance in the wallet after deducting the account maintenance fee and/or fund custody fee within the period specified by the Company, without any interest or compensation from the Company. The request must be made in advance through the channels designated by the Company and in accordance with the Company's specified procedures. If the specified period expires, the Company reserves the right to proceed in accordance with its internal policies.
  • In the case of a refund request, the Company will verify the accuracy of the request and transfer the remaining wallet balance to the user. The transfer will be made either to the user's bank account or to a new EPS Wallet account as specified by the user, in accordance with the Company's procedures and conditions. The Company reserves the right to charge a transfer fee if applicable.
10. User Representations and Warranties

10.1 If the user is a Lao citizen, the user represents and warrants that they have the legal capacity or have obtained the necessary legal consent to register and use the service, as well as to be bound by these Terms of Service and/or any related agreements. If you are the legal guardian of a user who owns an EPS Wallet account, you agree to register for the service and be bound by these Terms of Service and/or any related agreements on behalf of the user who owns the EPS Wallet account.
If the user is a foreign national, the user represents and warrants that they are at least fifteen (15) years old and have the legal capacity to be bound by these Terms of Service and/or any related agreements, in accordance with the laws of their respective country.
Furthermore, the service provider and/or the user's legal guardian understand that the user is responsible for any financial or other consequences arising from the use of the service, either through their own actions or by allowing a third party to use their registration information, password, or other personal data.

10.2 The user represents and warrants that they will not use the service for illegal financial transactions, including but not limited to gambling, sex trade, money laundering, or using the EPS Wallet account to gain personal or third-party benefits in a manner that resembles a payment agent, cash deposit/withdrawal service, or any business model that violates public order, good morals, intellectual property rights, or other legal provisions. The user also agrees not to attempt unauthorized access to the application or its connected networks, nor to engage in hacking, data theft, password mining, or any other method of data compromise.
If the user engages in any of these prohibited activities, leading to damages to the Company or any liability claims against the Company, the Company reserves the right to suspend or terminate the service immediately. The user will be fully responsible for compensating the Company for any damages incurred. The Company assumes no responsibility for any resulting losses.

10.3 The user represents and warrants that all information provided to the Company under Clause 2.1 of these Terms of Service, as well as any additional information submitted to the Company, is completely accurate. If the Company finds that the user has falsified documents or impersonated another individual—regardless of whether that individual has consented—the Company reserves the right to suspend or terminate the service immediately, and the user will be fully liable for any damages caused to the Company. This applies regardless of whether the user acted with fraudulent intent.

10.4 The user represents and warrants that, when verifying their identity through the Company's biometric face recognition process, they have personally completed the process and are not a twin or any other individual with a similar appearance. The user further acknowledges that any transactions conducted via the EPS Wallet account using biometric face recognition are their own and are valid. If any losses arise from such transactions, the Company shall not be held liable.

10.5 For identity verification purposes, the user represents and warrants that the national identification card used in the Company's verification process is their own, containing accurate, genuine, and up-to-date personal information. The photo on the identification card must accurately reflect the user's current appearance, without significant alterations due to plastic surgery or other modifications that may change their facial recognition. If such changes prevent the identity verification system from confirming the user's identity, the Company reserves the right to refuse service activation or suspend the service. The user agrees not to use such changes as grounds for claims or legal actions against the Company.
10.6 The user represents and warrants that they will comply with and cooperate with the Company's requests for information and/or additional documents necessary for service activation, transactions, or compliance with the regulations of the Bank of the Lao PDR, the Anti-Money Laundering Office, or any other applicable laws, both current and future.

10.7 The user represents and warrants that they are the true owner of the EPS Wallet account and the actual beneficiary of the account registered under their name. The user agrees to use the service solely for their own benefit and confirms that no other person has control over the EPS Wallet account. If the user wishes to update any information regarding the actual beneficiary of the account, they may request such changes through the Company's designated channels.
The term "actual beneficiary" refers to the natural person who is the true owner of the EPS Wallet account registered by the user or who has control over the account.


11. Company’s Limitation of Liability

11.1 The company will provide its services to the best of its ability to ensure customer satisfaction. Therefore, if any errors or delays occur in the company's services—whether due to computer systems, internet systems, electronic devices, or any other related systems, including mobile network services, regardless of the cause—the user agrees not to claim damages from the company for such issues.

11.2 The user acknowledges that the company is solely a service provider facilitating payments and/or the receipt of payments for goods and/or services and carrying out transactions as per the user’s instructions. Therefore, if any issues arise regarding the goods and/or services, including defects or disputes, the user must directly contact the seller and/or service provider to resolve them.
Furthermore, in providing payment acceptance services for goods and/or services, the company is not involved in any agreements, terms, rights, or obligations between the user and the seller and/or service provider. If any disputes arise due to the company’s payment acceptance services, such as overdue payments, partial payments, service suspension, or any other cases, the user is solely responsible for resolving such disputes, with the company having no involvement.

11.3 The company reserves the right not to be liable for any direct or indirect loss or damage to data on the user’s mobile phone, mobile device, or any other equipment resulting from the use of the service.

11.4 The company reserves the right not to be liable for any loss or damage to funds in the Source of Funds linked to the user's EPS Wallet account, including the balance in the user's wallet, resulting from the loss or theft of the user’s mobile device or other equipment, fraud, malware, computer viruses, or any other electronic attacks on the user’s mobile device or equipment used for the service, or any other force majeure events. The user must immediately request to suspend the use of the affected Source of Funds account by notifying the company, the bank, the financial institution, the credit or debit card issuer, or the Source of Funds provider. For funds in the user's wallet, the user may request to suspend the use of funds through the company’s designated channels.

11.5 The company operates solely as a service provider through the application and other designated channels (if any). The company is not involved, does not participate in, or endorse any actions taken by the user in relation to the service, the application, or other channels.
If the user engages in any illegal activities, whether intentionally or unintentionally, or causes harm to others—whether directly or indirectly—the user agrees to be solely responsible for such actions and any damages caused to third parties or affected individuals.

11.6 The company is not liable for any violations of data protection laws or any other laws resulting from the user concealing or providing inaccurate information to the company. If the user conceals or provides false information, the user agrees to be responsible for any resulting damages to the company and/or third parties.


12. Personal Data
The user agrees and acknowledges that the company may collect, use, or disclose personal data, including but not limited to national ID information, contact details, location data, phonebook information, and other data provided by the user, in the company’s possession, or lawfully obtained from other sources. This data will be used for purposes such as account registration, identity verification, service provision, customer support, inquiries, statistical analysis, research, fraud prevention, security enhancement, and delivering updates or benefits that may be of interest to the user. The company may also send notifications through the application or other contact channels provided by the user.
Additionally, the user acknowledges that the company may transfer or disclose personal data to affiliated entities that control or are controlled by the company, business partners, contractual parties, or third parties responsible for data processing within or outside the country. If personal data is transferred to a country with inadequate data protection standards, the company will ensure appropriate security measures are in place.

13. Language
Any translation of these Terms of Service into other languages is for user convenience only and does not intend to alter the terms. In case of any discrepancies between the Lao version and any other language, the Lao version shall prevail.


14. Governing Law
These Terms of Service shall be governed and interpreted in accordance with the laws of the Lao People's Democratic Republic, without regard to conflict of law principles.


15. Severability
If any provision of these Terms of Service is found to be invalid or unenforceable under any law, the remaining provisions shall continue in full force and effect.


16. No Waiver
Failure by the company to enforce any provision of these Terms of Service shall not be deemed a waiver of its rights to enforce such provision at a later time. Likewise, a waiver of any breach shall not be considered a waiver of any subsequent breach or other provisions of these Terms.
